2、应具备合法的经营资格，并按照工商行政管理部门核准的经营范围亮证照经营。

3、应按照约定的用途开展经营活动，自觉遵守甲方依法制订的各项规章制度及索票索证制度，服从甲方的监督管理。 4、应按期支付租金并承担因经营产生的各项税费。 5、应爱护并合理使用市场内的各项设施，如需改动应先征得甲方同意，造成损坏的还应承担修复或赔偿责任。 6、应按照各级行政管理部门的规定，本着公平合理、诚实信用的原则合法经营，不得损害国家利益及其他经营者和消费者的合法权益，并承担因违法经营造成的一切后果。 7、将场地转让给第三人或和其他租户交换场地的，应先征得甲方的书面同意，按规定办理相关手续，并不得出租、转让、转借、出卖营业执照。 8、应按照甲方的要求提供有关本人或本企业的备案资料。 9、建筑物外立面及建筑物内部非乙方承租场地范围内的广告发布权归甲方所有，未经甲方同意，乙方不得以任何形式进行广告宣传。

第八条合同的解除乙方有下列情形之一的，甲方有权解除合同，乙方应按照标准支付违约金：

1、不具有合法经营资格的，包括因违法经营被有关行政管理部门吊销、收回经营证照的。

2、未按照约定的用途使用场地，经甲方次书面通知未改正的。

3、利用场地加工、销售假冒伪劣商品的。

4、进行其他违法活动累计达次或被新闻媒体曝光造成恶劣影响的。

5、将场地擅自转租、转让、转借给第三人，或和其他租户交换场地的。

6、逾期日未支付租金的。

7、违反保证金协议的有关约定的。

8、未经甲方同意连续日未开展经营活动的。

9、违反甲方依法制订的规章制度情节严重或拒不服从甲方管理的。甲方或乙方因自身原因需提前解除合同的，应提前日书面通知对方，经协商一致后办理解除租赁手续，按照的标准向对方支付违约金，其他手续由乙方自行办理。因甲方自身原因提前解除合同的，除按约定支付违约金外，还应减收相应的租金，并退还保证金及利息。

第九条其他违约责任

1、甲方未按约定提供场地或用水、用电等市场内的经营设施致使乙方不能正常经营的，应减收相应租金，乙方有权要求甲方继续履行或解除合同，并要求甲方赔偿相应的损失。

2、甲方未按约定投保致使乙方相应的损失无法得到赔偿的，甲方应承担赔偿责任。

3、乙方未按照约定支付租金的，应每日向甲方支付迟延租金 %的违约金。

第十条免责条款因不可抗力或其他不可归责于双方的原因，使场地不适于使用或租用时，甲方应减收相应的租金。如果场地无法复原的，本合同自动解除，应退还保证金及利息，双方互不承担违约责任。

第十一条续租本合同续租适用以下第种方式：

1、乙方有意在租赁期满后续租的，应提前日书面通知甲方，甲方应在租赁期满前对是否同意续租进行书面答复。甲方同意续租的，双方应重新签订租赁合同。租赁期满前甲方未做出书面答复的，视为甲方同意续租，租期为不定期，租金标准同本合同。

2、租赁期满乙方如无违约行为的，则享有在同等条件下对场地的优先租赁权，如乙方无意续租的，应在租赁期满前日内书面通知甲方；乙方有违约行为的，是否续租由甲方决定。

第十二条租赁场地的交还租赁期满未能续约或合同因解除等原因提前终止的，乙方应于租赁期满或合同终止后日内将租赁的场地及甲方提供的配套设施以良好、适租的状态交还甲方。乙方未按照约定交还的，甲方有权采取必要措施予以收回，由此造成的损失由乙方承担。

第十三条争议解决方式本合同项下发生的争议，由双方协商解决或申请有关部门调解解决，协商或调解解决不成的，按下列第种方式解决（只能选择一种）： 1、提交北京仲裁委员会仲裁；

2、依法向人民法院起诉。

第十四条其他约定事项

1、场地在租赁期限内所有权发生变动的，不影响本合同的效力。

第十五条本合同自双方签字盖章之日起生效。本合同一式份，甲方份，乙方份，第十六条双方对合同内容的变更或补充应采用书面形式，并由双方签字盖章作为合同附件，附件与本合同具有同等的法律效力。甲方单方制订的规章制度也作为本合同的附件，规章制度的内容与合同约定相冲突的，以本合同为准，但国家法律、政策另有规定的除外。

根据中华人民共和国法律、法规和有关规定，甲、乙双方在平等、自愿、协商一致的基础上，签订本租凭合同，并达成以下协议：

一、甲方将洪梅汽车站商铺间租个乙方作为合法经营场地，商铺位于编号为建筑面积平方米。

二、租凭期限为年，从年月日至年月日止，合同期满后，在同等条件下乙方可优先续租，但必须提前一个月与甲方签订新的租赁合同，否则视为放弃优先权。

七、本合同期满双方不再续约的或者合同期间终止合同关系的，乙方须在10天之内将铺面交还甲方，交还时应当恢复原貌（如间墙、门窗、管道等），否则应当支付恢复原貌的费用，同时乙方负责自行清理所有杂物，并搞好卫生，租凭物内的装修材料（包括水管、电线、隔楼、门窗等）无偿归甲方所有。

八、非经甲方同意，乙方不得如建、翻修、不得改变原建主体结构和面局。租凭期间由乙方负责维修、保养，乙方必须配备防火器材，消除安全隐患。

九、乙方签订本合同后，因经营需要装修店铺的，须向甲方有关部门登记备案，执行并遵守甲方的有关部门规定（如统一制做招牌、用电安装等），并在合同生效之日起 30天内完成装修，并于日必须正常开门营业，否则甲方有权终止合同，没收押金，收回商铺。营业期间非特殊情况不得连续三天关门，否则视为违约。

十、甲方可以协助乙方办理相关证照，其费用由乙方承担。

十一、乙方应该按照约定时间缴纳各项费用，否则甲方有权停止对乙方的供水供电等，因此而造成的一切损失由乙方自负。甲方下达书面催缴通知后仍不履行的，则视为违约。甲方有权解除合同，无偿收回商铺及附属的设施设备及装修材料，且押金不予退还，并保留追收滞纳金的权利。

十二、乙方在本合同签订一年之内不得将物业转让，以后如确需要转让租凭权应向甲方提出书面申请，由甲方收取500元的转让手续费后方可办理转让手续，否则视为违约，则按违约处理。

十三、合同期内，乙方必须依法经营，遵守法律法规及《x治安管理条例》等，必须消除各种安全隐患，否则甲方有权责令乙方整改或终止合同并不作任何赔偿。

十四、本合同如有与法律法规相抵触的以法律法规为准，不尽事宜，甲、乙双方共同协商解决，或由仲裁委员会仲裁。
