九、违约及处理 Breach of the contract

1. 甲、乙双方任何一方在未征得对方谅解的情况下，不履行本合同规定条款，导致本合同中途中止，则视为该方违约，双方同意违约金为人民币___________元整，若违约金不足弥补无过错方之损失，则违约方还需就不足部分支付赔偿金。

租房防骗小知识

一、虚假宣传，引诱消费者签订合同。一些房屋中介公司以所谓“质优价廉”的房屋招徕看房客户。投诉案例中就出现过广告中假称家具家电设施转让，却在合同中不加注明，以至消费者购房与看房不实。

二、订立霸王合同，消费者权益无法保障。一消费者投诉称，某中介公司在签订合同时，约定无论是否经过其介绍，只要消费者与中介公司的信息房源签订了合同，就得向其支付中介费。这些条款是不合法的。

三、违规操作，使消费者利益受损。有的中介公司介绍给消费者的房屋属于非法或缺乏合法手续的房屋，致使购房户无法办理手续;有的房屋没有产权证无法购买，但中介公司为赚取中介费，却对购房者说不用办理手续，法律上这样的房子是得不到保障的。

四、巧立名目，收取各项费用。有的中介公司找种种借口，除正当中介费用外，还收取所谓看房费、咨询费等费用。

五、交费容易退费难。从投诉反映来看，交到中介公司手里的钱很难退回到消费者手上。比如租房到期后，中介公司应退还其房屋押金，但一些中介公司找出如东西损坏等借口，就是不退押金。

六、无证“黑中介”骗取钱财。一些没有固定经营场所、无证照的“黑中介”利用消费者的不知情骗取钱财，一旦被发现便溜之大吉。

2. 房屋设施如因质量原因、自然损耗、不可抗力或意外事件而受到损坏，甲方有修缮并承担相关费用的责任。如甲方未在两周内修复该损坏物，以致乙方无法正常使用房屋设施，乙方有权终止该合约，并要求退还押金。

In case the premise and attached facilities are damaged by quality problems， natural damages or accidents， Party A will be responsible to repair and pay the relevant expenses. If Party A can‘t repair the damaged facilities in two weeks so that Party B can’t use the facilities normally， Party B has the right to terminate the contract and Party A must return the deposit.

3.甲方应确保出租的房屋享有出租的权利，如租赁期内该房屋发生所有权全部或部分转移、设定他项物权或其他影响乙方权益的事件，甲方应保证所有权人、他项权利人或其他影响乙方权益的第三者能继续遵守本合同所有条款，反之如乙方权益因此遭受损害，甲方应负赔偿责任。

Party A must register this contract with the relevant government authority If not doing so resultingthat this contract is invalid or Party B‘s right of leasing may be damaged ， Party A should take the all responsibilities. Party A should also bear the all the relevant taxes.

七、乙方义务/ Obligations of Party B

1. 乙方应按合同的规定按时支付租金及押金。

Party B will pay the rental and the deposit on time.

2. 乙方经甲方同意，可在房屋内添置设备。租赁期满后，乙方将添置的设备搬走，并保证不影响房屋的完好及正常使用。

Party B may add new facilities with Party A‘s approval. When this contract expires， Party B may take away the added facilities without changing the good conditions of the premises for normal use.

In this situation， Party A has the right to take back the premises and take actions against party B's breach.

五、保证金 Deposit

1. 乙方在租赁期满后如需退租或续租，应提前两个月通知甲方，由双方另行协商退租或续租事宜。在同等条件下乙方享有优先续租权。

1. 甲方须按时将房屋及附属设施（详见附件）交付乙方使用。

2. 房屋设施如因质量原因、自然损耗或灾害而受到损坏，甲方有修缮并承担相关费用的责任。

In case the premise and attached facilities are damaged by quality problems， natural damages or disasters， Party A will be responsible to repair and pay the relevant expenses.

3. 甲方应确保出租的房屋享有出租的权利，反之如乙方权益因此遭受损害，甲方应负赔偿责任。

Party A will guarantee the lease right of the premises. Otherwise， Party A will be responsible to compensate Party B's losses.

七、乙方义务 Obligations of Party B

1. 乙方应按合同的规定按时支付定金、租金及保证金。

2. 乙方经甲方同意，可在房屋内添置设备。租赁期满后，乙方将添置的设备搬走，并保证不影响房屋的完好及正常使用。

八、合同终止及解除的规定 Termination and dissolution of the contract

第14条租赁期间，乙方如欲将房屋转租给第三方使用，须征得甲方书面同意。取得使用权的第三方即成为本合同的当然乙方，享有原乙方的权利和承担原乙方的义务，乙方不再承担本合同约定的权利与义务。

第15条租赁期间，甲方欲对房屋设立抵押权，须提前2个月书面告知乙方，乙方有权决定是否继续承租。如乙方在7日内无异议或不作为，则视为认可甲方的行为。如乙方作出决定终止本合同，则租赁关系自终止本合同通知书到达甲方的次日起计算。

第六部分房屋修缮

第17条租赁期间，甲方应负责房屋的正常维修，或委托承租方代行维修，维修费由甲方承担。甲方应保证房屋能满足乙方正常使用和居住之需要。

第18条租赁期间，如房屋发生非因乙方原因造成的自然损坏，或人为损坏，或屋面漏水等，影响乙方正常居住生活事由的，甲方应在接到乙方通知之日起7天内予以修缮，超过7天，乙方有权自行修缮。

第19条租赁期间，如房屋有倾倒危险，或其它严重妨碍乙方正常居住的，或威胁到乙方的生命财产安全的，甲方应在接到乙方的通知后立即进行修缮或暂时补救，如果甲方对此怠慢，或不予以理睬，或采取维修保养措施不力，乙方可以退租或代甲方修缮。

第20条对房屋进行的修缮费用，乙方可以抵销租金或向甲方索还，并可追究甲方违约责任。

第七部分甲方权利与义务

第21条甲方保证如实向乙方解释和说明房屋情况和周边概况，应包括房屋权属、房屋维修次数、物业管理、治安、环境等，及如实回答乙方的相关咨询，否则视为欺诈行为。

第22条甲方如未按本合同规定时间向乙方提供租赁房屋，每日向乙方偿付违约金人民币元，累计不超过3个月的租金。

第23条租赁期间，如甲方确需收回房屋自住，必须提前3个月书面通知乙方。解除合同后，甲方应支付违约金，违约金以剩余租期内应交租金总额的20%计算。

第24条租赁期间，如有政府或经正常合法程序审批的拆迁行为，则按照国家拆迁条例和当地的拆迁有关规定执行。

第八部分乙方权利与义务

第29条乙方在房屋内的装修及安装的设备、物品，在合同期满搬出时可一次折价转让给甲方;双方如无法达成协议，则乙方应自合同期满之日起7天内自行拆除，恢复至房屋原状。超过7天，甲方有权无偿保留或自行拆除，拆除费用由乙方在合理数额内承担。

第30条根据本合同约定提前终止合同或合同期满，乙方应在收到甲方正式书面通知之日起15天内搬出全部设备、物件，但双方另有协商除外。如乙方短期内另找房屋确实有困难或另有其它特殊情况，则甲方应允许乙方延期30天，但乙方应按本合同约定的租金一次性交清租金。搬迁后7日内房屋里如仍有余物，如双方无约定，视为乙方放弃所有权，由甲方处理。

第31条租赁期满或合同解除，如乙方逾期不搬迁，乙方应赔偿甲方因此所受的经济损失。
